Title IX wouldn't enter into it because it's not an action by the school.

Outsiders are coming up with the money and who's to say that some business in town won't pay a one of the women swimmers or soccer players? The only payment by the school covered by Title IX would be the stipend paid to Women b-ball players because an arm of the school is paying it. If it's computed on the same basis as for men, it's OK, especially if all the stipends are equal.
